1. Acceptance of Terms

By downloading, installing, or using the SabKi Sawari mobile application or website (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms constitute a legally binding agreement between you and SabKi Sawari.

2. Use of the App

The SabKi Sawari Platform is a technology service that connects passengers seeking intercity travel with independent van drivers operating on fixed routes. SabKi Sawari does not itself provide transportation services. We act as an intermediary between passengers and drivers.

You may use the Platform only for lawful purposes and in accordance with these Terms. You agree not to use the Platform in any way that violates any applicable local, national, or international law or regulation.

3. User Accounts

To access most features of the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your login credentials confidential and not share them with any third party
• Notify us immediately at support@sabkisawari.com if you suspect any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You must be at least 18 years of age to create an account and use the Platform.

4. Bookings & Payments

When you book a seat through SabKi Sawari, you are entering into a direct agreement with the driver for transportation services. SabKi Sawari facilitates this booking but is not a party to the transportation contract.

Currently, all payments are made in cash directly to the driver upon boarding. Fares are set by drivers and displayed on the Platform before booking. SabKi Sawari reserves the right to introduce digital payment methods in the future, at which point separate payment terms will apply.

By confirming a booking, you agree to pay the displayed fare in full at the time of boarding. SabKi Sawari does not guarantee any specific fare and fares may change between trips.

5. Cancellations

Passengers may cancel a confirmed booking at any time before boarding. Cancelling 2 or more hours before departure is free and releases the full held security deposit. Cancelling 60 to 119 minutes before departure may incur a 5% charge on the fare; cancelling 30 to 59 minutes before departure may incur a 10% charge; cancelling less than 30 minutes before departure may incur a 20% charge. If a passenger does not show up for pickup, 25% of the held deposit is forfeited. Any charge is deducted only from the held security deposit and never exceeds the amount held. Once boarded, ordinary cancellation is no longer available - passengers should use the in-app report-a-problem option instead. Please refer to our Refund & Cancellation Policy for full details.

6. Passenger Obligations

As a passenger, you agree to:

• Arrive at the designated pickup point on time
• Behave respectfully toward the driver and other passengers
• Pay the agreed fare in full upon boarding
• Not bring prohibited items into the vehicle
• Follow the driver's reasonable instructions during the trip
• Not engage in any conduct that endangers the safety of the driver or other passengers

7. Prohibited Activities

You may not use the Platform to:

• Post false, misleading, or deceptive content or reviews
• Harass, threaten, or intimidate drivers or other users
• Attempt to defraud drivers or SabKi Sawari
• Circumvent the Platform to arrange private bookings with drivers discovered through SabKi Sawari
• Use automated means to access or scrape the Platform
• Introduce malware, viruses, or other malicious code
• Impersonate any person or entity

8. Platform Liability

SabKi Sawari provides the Platform on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by applicable law, SabKi Sawari disclaims all liability for any direct, indirect, incidental, or consequential damages arising from your use of the Platform or the transportation services facilitated through it.

SabKi Sawari is not responsible for the acts or omissions of drivers, including but not limited to delays, accidents, or passenger misconduct. Drivers are independent service providers and are not employees or agents of SabKi Sawari.

9. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is the property of SabKi Sawari or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Platform content without our prior written consent.

10. Changes to Terms

SabKi Sawari reserves the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by sending a notification through the app. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Karachi, Sindh, Pakistan.
